Welcome to frankaugust.com (the "Site"). These Terms of Use ("Terms") govern your access to and use of the Site, which is owned and operated by Frank August, LLLP ("Frank August," "we," "us," or "our"). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.



1. Eligibility and age restriction

The Site contains information about alcohol products and is intended only for individuals who are of legal drinking age in their jurisdiction (21 years or older in the United States). By accessing the Site, you represent and warrant that you are of legal drinking age in your country and state of residence.

We do not knowingly market to or collect information from individuals under the legal drinking age. If you are not of legal drinking age, please do not use the Site.



2. Frank August is not a licensed alcohol retailer

Frank August is a producer and brand owner. Frank August is not a licensed beverage alcohol retailer and is not involved in the sale, shipment, or delivery of alcohol products to consumers.

All purchases of alcohol initiated through the Site are managed by an independent technology provider, Flaviar Checkout, and are processed and fulfilled by licensed alcohol retailers. When you click a "Buy" or similar button on the Site, you are routed to Flaviar Checkout, where the transaction is governed by Flaviar Checkout's Terms of Use, Refund Policy, and Privacy Policy. Please review those terms carefully before completing a purchase.



3. Use of the Site

You agree that you will not:

5. User-submitted content

If you submit any content to the Site (for example, comments, photos, reviews, or social media tags using our handles or hashtags), you grant Frank August a non-exclusive, royalty-free, worldwide, perpetual license to use, reproduce, modify, publish, and display that content in connection with the Site, our marketing, and our business operations. We do not warrant that the Site will be uninterrupted, error-free, secure, or free of viruses or other harmful components. Information on the Site (including product descriptions, ABV, pricing, and availability) may contain errors or omissions and is subject to change without notice.



8. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, FRANK AUGUST AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, OR DATA, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100).

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

These Terms are governed by the laws of the Commonwealth of Kentucky, without regard to its conflict of laws principles.
